NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN
OPEN TO RESIDENTS OF THE 50 UNITED STATES AND WASHINGTON D.C., 18 YEARS OF AGE AND OLDER ONLY
1. Sponsorship and Eligibility
This Contest is sponsored by Quest Nutrition, 777 S Aviation Blvd, El Segundo, CA 90245(“Quest”). There is no purchase necessary to enter or win. This Contest is open to legal residents of the fifty United States and Washington, DC who are eighteen (18) years of age or older at the time of entry and who meet the entrant qualifications; however, the Contest is void where prohibited by law. Quest reserves the right to request proof of age or identity. Employees of Quest and NASM and their affiliates, licensees, franchisees, advertising and promotional agencies are not eligible. Participants in the Contest agree that they have read, understood and accepted these Official Rules and agree to be bound by them, including all eligibility requirements and decisions of Quest. Quest reserves the right to revise any and all aspects of the Contest and these Official Rules at any time with or without notice to entrants.
2. Qualification Period
The period for submitting entries for the Contest begins at 12:00 AM (Pacific Standard Time-California) on December 26, 2018 and ends 11:59 PM (Pacific Standard Time-California) on January 25, 2019. This time period is called the “qualification period” or the “entry period.”
3. Entry Procedures; Entrant Qualifications; Scheduled Check-Ins
To enter the contest, sign up through the submission form on http://www.questnutrition.com during the Qualification Period. One entry per person. In order to be an eligible entrant, you must be a NASM CPT, PES and/or CES in good standing with a current and valid certification/recertificaiton at the time of entry. Otherwise, your submission is void.
After you’re granted entry, you must participate in all the necessary check ins on the check-in site a _____URL_______ on the following schedule:
• At 30 day (2/27/2019),
• At 60 day (3/29/2019), and
• At 90 day (4/28/2019).
If you successfully complete the Scheduled Check-Ins listed above, you will automatically qualify for the Contest Finale.
Please note that if your NASM CPT, PES or CES status changes (e.g. your certification is no longer valid or current) and you are no longer an NASM CPT, PES or CES in good standing at any time during the Contest, up through the announcement of the winner, you will be disqualified and no longer be deemed an eligible entrant.
4. Duties of Participants; Limitation of Liability; Disputes
By entering, participants agree to be bound by these rules and the decisions of Quest which shall be final and binding. All applicable laws apply. Quest and the employees, officers, directors, shareholders, agents, and representatives of Quest and its affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware, or software program, network, Internet, web site, social media platform or computer malfunctions, failures, or difficulties; (iii) errors in transmission or reception; (iv) any condition caused by events beyond the control of Quest that may cause the Contest to be disrupted or interrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the Contest; (vi) errors in these official rules or their interpretation or enforcement; or (vii) any printing or typographical errors in any materials associated with the Contest. By participating in the Contest, entrants (or entrant’s parent/legal guardian if any entrant is deemed a minor in the state/province or country of his/her residence) agree to release and agree to indemnify, defend and hold harmless Quest, the National Academy of Sports Medicine (NASM), their parent companies, subsidiaries, and affiliated companies, the employees, officers, directors, shareholders, agents, and representatives of Quest, NASM and their parent companies, subsidiaries, and affiliated companies, and their advertising, promotion and legal advisors (collectively, the “Released Parties”) from and against any and all claims, demands, losses, or cause of action for any damages (including, without limitation, all consequential, punitive, and incidental damages), liability, loss, cost, fees (including attorneys’ fees), including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize, and for claims based on publicity rights and intellectual property rights, defamation or invasion of privacy. Quest makes no warranty, representation or guarantee of any kind, express or implied, in fact or in law relating to any prize. This Contest is not sponsored by NASM. If, in Quest’s opinion, there is any suspected evidence of tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, Quest reserves the right to modify, cancel, suspend or terminate the Contest in whole or in part, at Quest’s sole discretion, including, without limitation, revoking any entrant’s entry into the Contest and/or revoking any winner’s prize award.
5. Governing Law; Disputes
Any dispute arising out of or relating to these official rules or this Contest shall be resolved by binding arbitration in accordance with the then current rules of the Judicial Arbitration and Mediation Service. The place of any arbitration shall be Los Angeles, California. Any issues or questions of construction, interpretation, validity, or enforceability of these rules, or the rights and obligations of the entrant and/or Quest in connection with the Contest shall be governed by, construed and interpreted in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rule which would cause the application of the laws of any jurisdiction other than the State of California.
6. Violation of Contest Rules
Quest reserves the right, in its sole discretion, to (a) void any and all entries of an entrant who Quest believes has attempted to tamper with or impair the administration, security, or fairness of the Contest, and/or (b) disqualify any participant or winner who, in its sole determination, tampers with the entry process, submits more than a single entry or violates these official rules.
7. Contest Duration; Selection of Winner; Chances of Winning;
The 90 Day Transformation Challenge Contest period, during which you must timely complete the Scheduled Check-Ins, will be from January 29, 2019 to April 28, 2019. April 28 marks the end of the 90 day period.
Top ten round:
TEN finalists will be selected by a panel consisting of NASM & Quest judges (Panel Judges) from among all eligible entrants who reach the Contest Finale by ______date and time ______.
The Panel Judges will select the top ten based on the following Panel Judging Criteria:
• The winner(s) should show a high percentage of body compensation change (% of fat mass to lean body mass) and a change in circumference measurements over the 90-day period.
• The pictures submitted should show progressive results per submission. We would like to see a gradual change over time and not a drastic change before the end of the challenge.
o Submit a template that can calculate the results for us (enter total body weight, body fat percentage and then from there it calculates the % of fat mass and lean body mass. If doing subsequent measurements, % of change from each check-in needs to be calculated. This is the same for circumference measurements.
• All check-ins must be met to earn a chance of winning.
• Must be a NASM CPT, PES and/or CES in good standing to be eligible. NASM will verify this before the Ten Finalists are announced.
The Ten Finalists will then move on to our final NASM panel selection round.
The Ten Finalists will then be judged by a panel comprised of 3 NASM Regional Master Trainers*. The RMI panel will convene before May 3, 2019. The ten finalists will notified of their by selection before May 4, 2019.
*This year’s judges are comprised of 3 NASM Regional Master Instructors (RMIs). Collectively, these instructors have over 60 years of professional training experience, carry a multitude of highly-qualified credentials, maintain peak business acumen, and a minimum Master’s Degree in the field of Exercise Science. RMIs carry the highest NASM instructor honor and work to develop other NASM Master Instructors, Master Trainers, and future fitness professionals. Their clients include, among others, people with neurodegenerative diseases, who require advanced injury prevention and rehabilitation services, who need professional-level athletic training and much more. NASM’s RMIs teach at conferences and tradeshows all over the globe and their published works can be found in numerous journals, textbooks and professional articles. NASM’s RMIs are proud to be part of this year’s challenge and honored to be included in selecting the winner.
The RMI panel will select a winner based on the following RMI Judging Criteria:
• A re-examination of the the criteria applied by the Panel Judges.
• A 500-word essay (details will be provided to Ten Finalists). The RMI Judges will look for a compelling story that explains why this challenge has helped transform the lives of the Trainer and his/her client in a positive way. This essay will be due on 5/8/19 before 11:59 p.m. Pacific Daylight Time.
• Must be a NASM CPT, PES and/or CES in good standing to be eligible. NASM will verify this before the Winner is announced.
ONE (1) winner will be announced on May 20, 2019 before 11:59 p.m. Pacific Daylight Time.
Odds of winning depend on the total number of eligible entries received.
8. Description of Prizes
There will be one (1) winner of the Contest,. The winner will receive one (1) prize package which will include the following prizes:
a) $10,000 prize (tentative on distribution)
b) A $75 stipend each month to spend on www.questnutrition.com for one (1) year ($900 value). *Winner will work with Quest administrator on monthly basis to fulfill stipend orders* (tentative)
c) All expenses paid trip to Los Angeles that includes board + food ($2,000 value)
d) An episode feature on the Quest Nutrition “Transformation” series.
e) NASM recertification fees covered for the entire duration of winner’s life. ($329 value)
9. Notification of Winners; Substitution of Prizes
The winner will be notified by Quest via email by May 20, 2019, that they are the winner. Neither Quest nor NASM is responsible or liable for lost, misdirected, or unsuccessful efforts to notify winners. If any Notification or attempted Notification is returned as undeliverable, the prizes may be forfeited and may be awarded to an alternate potential winner. Quest reserves the right, but is not required to, to use additional means to contact winner, at its sole discretion. If any winner does not reply to such Notification within five (5) business days of the date Quest first notified the winner that he or she had won the Contest, such winner will be disqualified and an alternate winner will be selected. Winner may not substitute or transfer prizes. Quest reserves the right to substitute a prize of equal or greater value in the event the prizes are unavailable. Prizes may be subject to reporting for tax and other purposes. Winners should consult their tax advisers with respect to any applicable taxes relating to any prize.
Except where prohibited by law, entry constitutes permission to use the winner’s name, hometown city and state, voice and likeness for online posting, and/or any advertising and publicity in any form without additional compensation. Acceptance of a prize constitutes a winner’s consent for Quest and NASM to print, publish, broadcast and use worldwide in any media now known or hereinafter known (including without limitation use online at the website) his/her name, likeness, biographical information, all entry materials provided by winner, voice, statements, photograph or other likeness without further notification or compensation for advertising, promotional and publicity purposes by Quest or NASM, using media of Quest’s or NASM’s choice. Nothing shall obligate Quest or NASM to so use or engage in any of the above. Winner (or winner’s parent/legal guardian if any winner is deemed a minor in the state of his/her residence; all entrants must be at least 18 years old) may also be required to sign and return a release of liability, declaration of eligibility and, where lawful, a publicity consent agreement, as conditions of receiving a prize. Failure to comply with the aforementioned conditions shall be grounds for forfeiture of a prize. In such a case, an alternate winner will be selected at random from the eligible entries.
If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
